THE SCOPE AND LIMITS OF OUR ACCOUNTABILITY

All good relationships operate on Consent and Expectation Management.  When Consent and Expectation Management fail, we resort to the terms and conditions of the engagement.  The intention of this section is to cover both Expectation Management and the Ts & Cs, for the peace of mind of both parties.

Definition of Terms

  1. myMojoDojoLife, Eyes Wide Open Life and the proprietors are referred to as “US/ WE”.
  2. Any member of the public and/or Members, Subscribers making use of the resources, content and practices are referred to as “I / YOU”
  3. The content, resources and practices throughout the entire site, pages, posts, newsletters, emails and online session, including any and all advice given during any related interaction, written, verbal, diagramatic or otherwise, is referred to as “CONTENT”.
  4. Engagement with, consideration and / or application of the Content and Practices, as a member of the public, a current or past subscriber is referred to as ‘USE’.

The Content, Resources & Practices

  1. The Content, presented by Us, is presented in good faith to the public and to members. That means the primary intention is to assist You in your own journey of self-development and wellness.
  2. We have taken care to indicate which is Member Content and which is Public Content.
  3. The Content is based, to the extent of our knowledge, on sound psychology, behavioural science and neuroscience.  That said, we are neither psychologists or certified therapists, and We share the Content for the betterment of well people.
  4. We are not Doctors, Psychologists or Clinicians and we advise anyone with dire concerns about their psychological stability, their wellness or mental health to consult a professional.
  5. Any and all Content including advice, including but not limited to the Lessons, Lesson Notes, Direct Guidances, Meditations is general in nature and we expect You to apply your own discretion in how You apply the Content.
Suggestions, Concerns & Feedback
  1. We do take all suggestions, concerns and feedback seriously, and You are encouraged to submit all such feedback via the Suggestion Form, which are discussed monthly in an effort to improve the website and the way We interact and engage with You.
  2. All issues and requests raised are prioritised according to our discretion.  A suggestion raised by You does not necessarily obligate Us, in so far as there are limitations to our liability and means, and all requests are considered against the needs of all Members.
Data, Website and Supporting Technology
  1. We have taken reasonable measures to ensure the website is safely hosted and backed up regularly but ultimately we are at the mercy of power and technology providers and as such we cannot control their availability or performance.
  2. We record all sessions including but not limited to Main Weekly Classes, Weekly Catch-ups and Monthly Retros, but are reliant ultimately on our power and internet connectivity, and platforms such as Zoom, Calendly and YouTube, but cannot control or ensure their availability or performance.
  3. We do not and will not share your data with any commercial third party under any circumstances, but We cannot control nor be held liable for the quality of data security of platforms such as Internet and Hosting service providers and any data breach at their level which might affect Us and / or their other customers and users.
  4. By design, all membership transactions are managed completely by Stripe, widely considered a Trusted payment gateway. Their security documentation can be found here
  5. By design, we do not hold or handle your credit card data that you provide during registration, this is strictly between yourself and the payment gateway.

The Terms and Conditions of Use for Members / Subscribers

  1. We have taken care to indicate which is Member Content and which is Public Content.
  2. You agree not to share Member Content with any non-Member, this includes but is not limited to lesson contents and images, practices, audio content and YouTube Videos, whole or in part.
  3. You understand, acknowledge, and agree to the participation requirements for any and all of the classes, programs, and/or activities you engage in.
  4. You understand, acknowledge and agree that all sessions you attend are recorded and will be shared on the website and/or YouTube and that We reserve the right to store and share that content to any current and future paying Subscribers.  
  5. You understand, acknowledge and agree that the recorded content constitutes not only our Intellectual Property but also material and consequential value for Us.  Every recorded session has unique and emergent value that cannot be re-recorded and reproduced and therefore any requests to remove recorded sessions from the online catalog of Content represents an impairment of value to our Members / Subscribers and an unacceptable impact to our sustainability as a business. 
  6. You understand, acknowledge and agree that We are not obliged to edit or redact any recorded content that you later wish us to remove. In the event that We do agree to edit or redact recorded site content, the requesting party will be wholly liable for any effort to edit, republish and re-integrate edited version of the content back into the site, and any related work will not be completed until the requesting party has agreed in full to the liability, and has further waived Us of any and all recourse, financial, legal or otherwise.
  7. You understand, acknowledge and agree that The Content provided is done so in good faith, for the betterment of well persons and You are responsible for applying your own discretion in the consideration and application of any and all advice or information.
  8. You understand, acknowledge and agree that Your grasp and understanding of the The Content is not within Our control and that all the responsibility for validation and verification sits wholly with you.  Effort will be made to respond to all questions and requests for verification but ultimately You are responsible for your progress and integration of the Content.  Additionally current members can book 1-on-1 sessions at a discounted rate, to procure dedicated time with the instructors to provide any deeper articulation required.
  9. You understand, acknowledge and agree that Your Use of the The Content constitutes general advice and You are expected to exercise your own discretion in the consideration and application of the Content, now and into the future.
  10. You understand, acknowledge and agree that We reserve the right to terminate your Membership / Subscription immediately if your conduct towards Us or any of the other members is deemed inappropriate or harmful, regardless of the intention or your or any other third party’s estimation of the consequential harm.
Billing and Refunds
  1. You understand, acknowledge and agree that in the event that your membership is terminated, by either party for any reason, membership subscriptions are not refundable.  
  2. All billing queries can be raised via our Contact page.
  3. Membership can be cancelled at any time, under the Profile Section.
 Liability and Risk Waiver
  1. I understand, acknowledge and agree and hereby release owners, agents or employees  from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death that may be sustained by me, while engaging with, considering or applying any and all of the Content.
  2. By agreeing to these Terms I hereby assume and acknowledge all risk, exposure, and liability, emotional, psychological or otherwise associated with your consideration, application and / or participation before, during, or after the term of your subscription.
